Quantum Law Group is representing a group of physicians in a significant partnership dispute brought by a former partner involving allegations concerning compensation, financial management and discrimination.
The partnership agreement required disputes among the partners to be resolved through arbitration. When the former partner sought to avoid arbitration, Quantum successfully pursued enforcement of the arbitration provision and defended that result through multiple appellate challenges.
The opposing party filed multiple writ petitions challenging the rulings requiring the dispute to proceed in arbitration. Quantum successfully opposed those petitions. After one of the challenges was taken further, the California Supreme Court denied the former partner’s petition for review.
The underlying physician partnership dispute is now proceeding in private arbitration, where Quantum continues to represent the partnership.
The matter demonstrates the complexity that can arise when disputes develop within long-standing medical practices. Partnership agreements, compensation arrangements, governance provisions and dispute-resolution clauses can all become central issues when a physician separates from a practice. Quantum represents businesses and professional practices in high-stakes partnership and ownership disputes, including matters involving physicians and other closely held businesses.
